AUCTION TERMS & CONDITIONS

Aarwun Gallery Annual Art Auction 2026

Registration & Eligibility

All bidders must complete registration prior to participation in the auction. Registration is subject to approval by Aarwun Gallery, which reserves the right to accept or decline any application at its sole discretion.

A valid form of identification (including but not limited to a driver’s licence or passport number) may be required for verification purposes.

All bidders confirm that information provided during registration is true, accurate, and complete.

Privacy & Personal Information

Aarwun Gallery collects personal information solely for the purpose of auction registration, bidder identification, administration, and related operational requirements.

This information may include name, contact details, address, and identification details.

All personal information is stored securely and will not be disclosed to third parties except where required by law.

By registering, bidders consent to the collection and use of their information for auction-related purposes.

Auction Participation

Bidders may participate in person, by telephone, or by absentee bidding (where applicable).

Aarwun Gallery accepts no responsibility for errors, delays, or communication failures during bidding.

The Gallery reserves the right to refuse any bid without providing justification.

Bidder Responsibilities

All bidders are responsible for understanding the nature of the auction and the items offered for sale.

By placing a bid, bidders acknowledge that all bids are final and legally binding.

Successful bidders enter into a binding contract of sale.

Auction Process

Aarwun Gallery reserves the right to:

  • Withdraw any lot from the auction at any time

  • Combine or separate lots

  • Change the order of sale

  • Resolve disputes at its sole discretion

  • Refuse any bid without explanation

Buyer’s Premium & Charges

A buyer’s premium of 20% plus GST applies to all successful hammer prices.

A 3% admin fee applies to all credit or debit card payments.

All charges are added to the hammer price to form the total purchase price payable.

Reserve Prices

Certain works may be subject to reserve prices. Where applicable, works will not be sold below the reserve price set by the vendor.

Payment & Sale Terms

Successful bidders will be invoiced following the auction.

Full payment for items purchased must be made on the day stated on the invoice unless otherwise agreed in writing.

Ownership of artworks will not transfer until full payment has been received.

Title & Risk

Title passes to the buyer only upon full payment.

Risk in the artwork transfers to the buyer at the fall of the hammer.

Layby Terms (Optional)

Layby is available subject to approval with the following conditions:

  • Minimum purchase value of AUD $1,000

  • 30% non-refundable deposit required upon approval

  • Balance must be paid in full within three (3) months

  • Failure to complete payment may result in cancellation and forfeiture of deposit

No Cooling-Off Period

All auction sales are final. No cooling-off period applies.

Warranties & Condition of Works

All works are sold “as is” unless otherwise stated.

No guarantees are made regarding condition, attribution, authenticity, or provenance.

Liability

Aarwun Gallery shall not be held liable for any loss, damage, or injury arising from participation in the auction, except where such liability cannot be excluded under Australian law.

Amendments

Aarwun Gallery reserves the right to amend these Terms & Conditions at any time. The most current version applies to all bidders.

Acceptance of Terms

By registering and participating in the auction, bidders confirm that they have read, understood, and agree to be bound by these Terms & Conditions and the Conditions of Sale.
